1. Information We Collect
MX Staffing LLC (“we,” “us,” or “our”) operates the website at mxstaff.com. We collect information you voluntarily provide to us, including:
- Your name and phone number when you submit a contact or booking request, along with your IP address and the exact timestamp of submission as a record of your consent
- Your name, email address, WhatsApp number, country of residence, and professional background when you submit a talent application through /apply
- Any other information you provide through our forms or direct communications
We also automatically collect certain technical data including your IP address, browser type, pages visited, and on-site behavior through standard web analytics tools.
2. How We Use Your Information
We use the information we collect to:
- Contact you regarding your staffing inquiry or placement request
- Evaluate talent applications and match candidates to client needs
- Respond to questions and provide customer support
- Send calls or text messages to the phone number you provided, where you have given us your prior express written consent to do so
- Improve our website, marketing, and services
- Comply with applicable laws and regulations
We will never sell your personal information to third parties for their own marketing purposes.
3. Meta Pixel & Advertising
Our website uses the Meta Pixel provided by Meta Platforms, Inc. This technology allows us to measure advertising effectiveness, build retargeting audiences, and understand how visitors interact with our site. The Meta Pixel may collect data including your IP address, browser information, and actions taken on our website. This data is processed by Meta in accordance with Meta’s Data Policy. You may opt out at facebook.com/ads/preferences.
4. Cookies
We use cookies and similar tracking technologies to enhance your experience. 6. Data Retention & Your Rights
We retain personal information only as long as necessary to fulfill the purposes outlined above or as required by law. Contact and lead information is retained for up to 24 months. Talent application data is retained for up to 36 months.

Our services are directed to business owners and professionals. We do not knowingly collect information from individuals under 18.
7. SMS & Telephone Communications Consent (TCPA)
When you submit a form on mxstaff.com, you are given the option to provide your prior express written consent to receive calls and text messages from MX Staffing LLC. This section explains how that consent works and your rights under the Telephone Consumer Protection Act (TCPA).
Consent language presented at time of submission: "By submitting, I consent to receive calls & texts from MX Staffing LLC at the number provided, including via automated technology. Msg & data rates may apply. Reply STOP to opt out."
What your consent covers:
- Calls and/or SMS/MMS text messages to the phone number you provided on the form
- Communications made using automated technology, including autodialed calls, prerecorded voice messages, and automated SMS platforms
- Messages related to your staffing inquiry, follow-up communications, appointment reminders, and relevant service updates
Message & data rates: Standard message and data rates may apply depending on your mobile carrier plan. MX Staffing LLC is not responsible for any charges applied by your carrier.
Message frequency: Message frequency varies. You may receive messages related to your inquiry, scheduling, and service updates.
How to opt out: You may withdraw your consent to receive text messages at any time by replying STOP to any text message you receive from us. After opting out, you will receive one final confirmation message and no further texts will be sent. To opt out of phone calls, contact us at hello@mxstaff.com and we will honor your request promptly.

How we record your consent: At the time you submit a form and check the consent box, we automatically record your IP address and the exact UTC timestamp of submission. This record is retained for a minimum of 36 months and constitutes proof of your prior express written consent as required under the TCPA and applicable FCC regulations.
Consent is not required: Your consent to receive marketing calls or texts is not a condition of purchasing any goods or services from MX Staffing LLC. You may contact us directly by email without providing telephone consent.
8. California Privacy Rights (CCPA / CPRA)
If you are a resident of California, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) grants you additional rights regarding your personal information.
Your California Rights:
- Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, our purposes for collecting it, and any third parties with whom we share it.
- Right to Delete: You may request deletion of personal information we have collected, subject to certain exceptions.
- Right to Correct: You may request correction of inaccurate personal information we maintain about you.
- Right to Opt Out of Sale or Sharing: We do not sell your personal information for monetary consideration. However, we do use the Meta Pixel, which may constitute "sharing" of personal information for cross-context behavioral advertising under CCPA. You may opt out of this sharing by visiting facebook.com/ads/preferences or using a browser opt-out tool.
- Right to Limit Use of Sensitive Information: We do not collect sensitive personal information as defined under CPRA.
- Right of Non-Discrimination: We will not discriminate against you for exercising any CCPA/CPRA rights.

Under California's "Shine the Light" law (Cal. Civ. Code § 1798.83), California residents may also request information about disclosures of personal information to third parties for their direct marketing purposes during the preceding calendar year. By accessing mxstaff.com, submitting a form, making a payment, or engaging MX Staffing LLC in any capacity, you (“Client”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.
1. Nature of Service
MX Staffing LLC is a staffing placement and introduction agency. Our service consists of sourcing, vetting, and introducing qualified bilingual professionals (“Contractors”) to Client for remote work engagements. MX Staffing LLC acts solely as an intermediary. We do not supervise, direct, control, or manage the day-to-day work performed by any Contractor once placement is made.
MX Staffing LLC is not a staffing agency that employs and deploys workers. We are a placement service. Once a Contractor is selected and work begins, the working relationship is directly between the Client and the Contractor. MX Staffing LLC is not party to that relationship and bears no responsibility for the Contractor’s performance, conduct, availability, or output after placement.
2. Hours, Availability & Attendance
Advertised plans reference approximately 160 hours per month as a general description of a full-time engagement. This figure is an approximation and is not a guarantee of any specific number of hours. Actual hours worked depend on the Contractor’s availability, the Client’s operational needs, agreed schedules, and other factors outside MX Staffing LLC’s control.
MX Staffing LLC makes no warranty and accepts no liability with respect to:
- A Contractor’s attendance, punctuality, or reliability on any given day or period
- Absences due to illness, personal matters, emergencies, internet or power outages, or any other reason
- Reductions in output or hours resulting from causes beyond our reasonable control
- Any impact on Client’s business caused by a Contractor’s absence or reduced availability
Contractors are independent professionals. MX Staffing LLC does not guarantee that any Contractor will work a fixed number of hours per day, week, or month. If a Contractor’s availability becomes insufficient for Client’s needs, Client’s remedy is to request a replacement under Section 5 below, subject to its terms.
3. Independent Contractor Relationship
All professionals placed by MX Staffing LLC are independent contractors, not employees of MX Staffing LLC or of the Client. Nothing in these Terms creates an employment relationship, joint venture, partnership, or agency relationship between MX Staffing LLC, the Contractor, and/or the Client.
Client acknowledges and agrees that:
- MX Staffing LLC is not responsible for any employment taxes, benefits, insurance, workers’ compensation, or payroll obligations related to any placed Contractor
- MX Staffing LLC is not liable for any acts, omissions, negligence, or misconduct of any Contractor
- Client assumes full responsibility for managing, directing, and supervising any placed Contractor during the engagement
- If Client chooses to treat or classify any Contractor as an employee under applicable law, Client bears sole responsibility for any resulting legal or tax obligations
4. Payment, Fees, Refund Policy & Chargeback Waiver
All fees are billed on a recurring monthly basis as described in the applicable plan selected at the time of purchase. By completing payment, Client expressly agrees to all terms in this Section.
ALL FEES ARE STRICTLY NON-REFUNDABLE. Once a payment is processed, no refund will be issued under any circumstances, including but not limited to: dissatisfaction with a placed Contractor, changes in Client’s business needs, failure to utilize the service, early cancellation, or disputes regarding hours worked. The only exception to this policy is a documented billing error caused solely by MX Staffing LLC (e.g., a duplicate charge), which will be corrected promptly upon written notice.
Service commencement. Client acknowledges that MX Staffing LLC begins performing services immediately upon receipt of payment. This includes, but is not limited to, initiating the candidate sourcing, screening, and shortlisting process. Because service delivery begins immediately, no cooling-off period, cancellation right, or right of withdrawal applies to any payment made. Client waives any right to claim that services were not rendered or that performance had not yet begun.
Recurring billing.
- Monthly fees are due at the start of each billing cycle and are earned in full upon billing
- No prorated refunds are issued for partial months under any circumstances
- To cancel future billing, Client must provide written notice to our support team at least 7 calendar days before the next scheduled billing date
- Cancellation takes effect at the end of the current paid billing period only; the current period’s fee is non-refundable
- MX Staffing LLC reserves the right to suspend or terminate service immediately if payment is not received within 5 business days of the due date, without liability to Client
Chargeback waiver and dispute resolution. By making a payment to MX Staffing LLC, Client expressly agrees that:
- Client will not initiate a chargeback, payment dispute, or reversal with any bank, card issuer, or payment processor (including Stripe) for any charge made in accordance with these Terms
- Before disputing any charge, Client must first contact MX Staffing LLC in writing at our billing support email and allow a minimum of 10 business days for resolution
- Initiating a chargeback without following the above process constitutes a material breach of these Terms
- In the event of an unauthorized or disputed chargeback, MX Staffing LLC reserves the right to: (a) immediately terminate all services; (b) submit these Terms, payment records, and evidence of service delivery to Stripe and any relevant financial institution as documentation that the charge was authorized and earned; (c) pursue the full disputed amount plus a $150 administrative fee per incident through collections or legal proceedings; and (d) seek recovery of reasonable attorneys’ fees and costs
- Client acknowledges that MX Staffing LLC will provide Stripe and any applicable dispute resolution body with a copy of these Terms and any evidence of service performance as part of chargeback defense
All payments are processed securely through Stripe, Inc. MX Staffing LLC does not store or have access to Client’s full payment card details. By completing a Stripe payment, Client also agrees to Stripe’s terms of service.
5. 90-Day Replacement Policy
As a discretionary service gesture, MX Staffing LLC may offer to source a replacement Contractor at no additional placement fee if a Contractor placed under an active, paid plan is demonstrably underperforming within the first 90 calendar days of the engagement.
This replacement policy is a goodwill gesture only. It is not a guarantee, warranty, contract right, or condition of service, and it does not create any entitlement to a refund of any fees paid.
The following conditions and limitations apply:
- The policy applies only within the first 90 calendar days from the Contractor’s confirmed start date, while Client’s account is current and paid in full
- Client must submit a written replacement request to MX Staffing support describing the specific performance concern with supporting detail
- MX Staffing LLC retains sole discretion to evaluate whether a replacement request is valid and whether a replacement will be offered
- The policy does not apply if: (a) the Contractor’s departure or underperformance was caused in whole or in part by Client’s conduct, instructions, work environment, or communication; (b) Client failed to provide necessary onboarding, access, or direction; (c) Client terminated the engagement for business reasons unrelated to the Contractor’s performance; or (d) Client’s account has any outstanding balance
- MX Staffing LLC will use commercially reasonable efforts to present replacement candidates within 48 hours of a valid accepted request. This timeframe is a good-faith estimate only and is not a binding or enforceable commitment
- The replacement policy does not entitle Client to any monetary refund, credit, or fee reduction under any circumstances. Client’s sole remedy under this policy is the sourcing of a replacement Contractor
- Invoking or attempting to invoke this policy as grounds for a chargeback, payment reversal, or payment dispute constitutes a breach of Section 4 and these Terms in their entirety
6. Client Responsibilities
Client agrees to:
- Provide a respectful, professional, and lawful working environment for placed Contractors
- Not request that any Contractor perform work that is illegal, unethical, or in violation of applicable laws
- Not directly solicit, hire, or attempt to independently retain any Contractor introduced by MX Staffing LLC outside of the MX Staffing LLC platform for a period of 12 months following the conclusion of any engagement, without MX Staffing LLC’s prior written consent
- Promptly notify MX Staffing LLC in writing if a Contractor relationship is no longer required or if concerns arise regarding a Contractor’s performance
7. Electronic Consent, Record-Keeping & Proof of Agreement
By completing a purchase, subscribing to a plan, or checking any acceptance box on our website or checkout page, Client consents to the following:
- MX Staffing LLC records and stores the following data at the time of each transaction as proof of Client’s agreement to these Terms: Client’s IP address, browser type and version, device information, geographic location (based on IP), the exact date and time of the transaction (UTC), the specific plan or service purchased, the amount charged, and a record of which terms, policies, and checkboxes were presented and accepted
- This record constitutes conclusive evidence that Client reviewed, understood, and agreed to these Terms at the time of purchase
- MX Staffing LLC will retain these records for a minimum of 36 months and may submit them as evidence to Stripe, any card issuer, financial institution, arbitrator, or court in connection with any payment dispute, chargeback, or legal proceeding
- Client acknowledges that this electronic acceptance is legally binding and equivalent to a handwritten signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA)
8. Billing Descriptor & Charge Recognition
Charges from MX Staffing LLC will appear on Client’s bank or credit card statement as “MXSTAFFING” or “MX STAFFING LLC” or substantially similar. Client acknowledges this billing descriptor and agrees to recognize charges from MX Staffing LLC on their statement.
If you do not recognize a charge: Contact us at our email address BEFORE contacting your bank or card issuer. Filing a chargeback for a charge you authorized is a breach of these Terms and will be contested with full transaction records and proof of service.
9. Service Delivery Confirmation & Documentation
Upon receipt of payment, MX Staffing LLC will send Client a confirmation email to the email address provided at checkout. This confirmation will include: the plan or service purchased, the amount charged, the date of purchase, and a summary of what Client can expect next (including the candidate sourcing timeline).
This confirmation email constitutes proof that:
- The transaction was authorized by Client
- Client was informed of the service purchased and the non-refundable nature of the charge
- Service delivery commenced immediately upon payment
MX Staffing LLC will also document and retain records of all service activity performed on Client’s behalf, including but not limited to: candidate searches initiated, candidates presented, communications sent, and Contractor assignments made. These records may be submitted as evidence of service delivery in connection with any dispute.
Client’s failure to respond to emails, review candidates, or utilize the service does not constitute non-delivery of service. MX Staffing LLC’s obligation is to source and present qualified candidates; Client’s decision not to engage does not entitle Client to a refund or chargeback.
10. Explicit Client Acknowledgments
By completing payment, Client expressly acknowledges and agrees to each of the following. These acknowledgments are material terms of the transaction and will be presented as evidence in any dispute:
- I understand that all fees are non-refundable and that no refund will be issued for any reason, including dissatisfaction, non-use, early cancellation, or change of mind
- I understand that services begin immediately upon payment, including candidate sourcing and screening, and that I waive any right to a cooling-off period or cancellation window
- I understand the 3-month minimum commitment and that I am responsible for all Monthly Service Fees through the end of the Minimum Commitment Period, even if I cancel early
- I understand that the 90-day replacement policy is a discretionary goodwill gesture and does not entitle me to any refund, credit, or fee reduction
- I understand that filing a chargeback without first contacting MX Staffing LLC is a breach of these Terms and that MX Staffing LLC will contest any chargeback with full transaction records, proof of service, and these signed acknowledgments
- I understand that MX Staffing LLC is a placement service and is not responsible for the performance, attendance, or conduct of any Contractor after placement
- I understand that charges will appear on my statement as “MXSTAFFING” or “MX STAFFING LLC” and I will not dispute a charge solely because I do not recognize the billing descriptor
- I acknowledge that buyer’s remorse, change of business plans, or deciding I no longer need the service after payment does not constitute grounds for a refund or chargeback
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MX STAFFING LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES PROVIDED, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF MX STAFFING LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ANY EVENT, MX STAFFING LLC’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT TO MX STAFFING LLC IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
This means: if something goes wrong — a Contractor calls out, misses work, performs poorly, or causes a business disruption — MX Staffing LLC’s maximum responsibility is limited to refunding up to 3 months of fees. We are not responsible for lost contracts, lost revenue, or downstream business impact.
12. Indemnification
Client agrees to indemnify, defend, and hold harmless MX Staffing LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Client’s use of the services; (b) any Contractor engagement managed or directed by Client; (c) Client’s breach of these Terms; or (d) Client’s violation of any applicable law or third-party right.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided by MX Staffing LLC shall first be submitted to good-faith negotiation between the parties. If not resolved within 30 days, the dispute shall be resolved by binding arbitration administered in accordance with the American Arbitration Association’s Commercial Arbitration Rules. Arbitration shall take place in Wyoming. The parties waive any right to a jury trial.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party’s intellectual property rights.
14. Changes to These Terms
MX Staffing LLC reserves the right to update or modify these Terms at any time. When we do, we will update the “last updated” date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
